Privacy Policy & GDPR
Sophie Atkins Photography complies with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation), effective from May 2018.
EMAIL MARKETING
Sophie Atkins Photography does not engage in email marketing specific to our services. Your personal details will not be used for such marketing purposes nor will they be passed on to any third parties.
CLIENT GALLERIES
Sophie Atkins Photography creates a private client gallery for each booking to whom photos are delivered as part of the services contracted. Sophie Atkins Photography's website and client galleries are hosted by Pixieset. To visit a Sophie Atkins Photography client gallery you will be required to either visit a private website link supplied to you, or a public link that will require you to enter your email address and a password. No entry of personal data is needed any further than an email address to access these galleries.
Email addresses are collected at this point to monitor gallery activity only.
CLIENT DATA & PHOTOGRAPHS HELD ON FILE
We take care extreme care over the processes around looking after of any personal data stored on our physical systems. Sophie Atkins Photography holds the following personal data of clients: i) names ii) addresses iii) phone numbers iv) email addresses within a password protected CRM software and business Gmail email account only. No information is stored anywhere outside of these two softwares and any paper copys made (during a wedding meeting or in person) will be destroyed once the booking is complete.
Every photograph taken by Sophie Atkins Photography is backed up to 2 password encrypted external hard drives and a online backup to Backblaze for added protection against the loss of images only. Clients reserve the right to refuse the online backup but must be aware that this may increase their chances for loss of images.
No one other than Sophie Huzzard has access to any of these accounts.
CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Sophie Atkins Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Sophie Atkins Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Sophie Atkins Photography as detailed in this privacy policy. In terms of explicit GDPR compliance, all clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’.
The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Sophie Atkins Photography as a photography business unless there is a good reason to protect a given individual's personal data which overrides those legitimate interests. Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.
SOCIAL MEDIA POLICY & USAGE
We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.
PROMOTIONAL USE OF IMAGES
To enable the continued work of Sophie Atkins Photography, I reserve the right, with your consent, to select photographs to be used for promotional purposes. To promote Sophie Atkins Photography, photographs may be displayed on the Sophie Atkins Photography website, blog, social media and on brochures/flyers that promote my services. Photographs occasionally will be submitted to lifestyle photography blogs, on lifestyle photography related websites and magazine articles; providing that the images used are used lawfully and without damage to Sophie Atkins Photography's client(s). Some images that show no identifying information may be used on stock websites. The rights of the people captured in these photographs are protected by Sophie Atkins Photography as detailed in this privacy policy. Sophie Atkins Photography respects the privacy of every client.
CHILD POLICY & DBS
Unless given written consent from a parent/guardian, no images of any children under the age of 18 will be used on social media or for any marketing or promotional material shared with the public. Children's names may be requested in advance to help assist with photo ordering and delivery of images at an event, school or prom where a parent/guardian may not be present, but this information is not stored or shared any further than the initial order form and any paper copies will be destroyed after the event is completed. Parents/guardians reserve the right to not include their child's name when placing an order with Sophie Atkins Photography.
Sophie Huzzard has an up to date (2026) enhanced DBS and will ensure any staff who attend any bookings for schools, events or proms involving mainly children under 18 are also DBS checked. All documents can be seen on request.
WITHDRAWL OF CONSENT
Anyone photographed by Sophie Atkins Photography, whether a client or wedding guest, and whether past or current may withdraw consent for a photograph in which they appear to be displayed at any point. The process for this is to email Sophie Atkins Photography and specify the photo in question. With that request, Sophie Atkins Photography will then remove the photo from online and printed display wherever it appears with immediate effect.
By clicking 'submit' on your contact form or placing a print order, you hereby are consenting to Sophie Atkins Photography to receiving and storing your contact details. Clients are reminded that if you do not wish for your email to be kept on the system then please state so.
PRIVACY POLICY
Addresses are requested for any clients' print orders, USB presentation box and albums. They will not be used for marketing purposes or any other reason.
